These Terms of Use ("Terms") govern your access to and use of the CringeAlert!! website and services ("CringeAlert!!", "we", "us", or "our"). By creating an account, accessing, or using CringeAlert!!, you agree to be bound by these Terms. If you do not agree, do not use CringeAlert!!.

1. Who we are

CringeAlert!! is an online service based in Oakland, California, United States. For information about how we collect and use personal information, please see our Privacy Policy.

2. Eligibility and accounts

• You must be at least 13 years old to use CringeAlert!!.
• You are responsible for the accuracy of the information you provide when you create your account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us promptly if you believe your account has been accessed without your authorization.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or are using CringeAlert!! in a way that could cause harm to us or others.

3. User content

3.1 Your content

"User Content" means any content you submit, upload, post, or otherwise make available on or through CringeAlert!!, including text, images, profile information, and interactions.

You retain any ownership rights you have in your User Content. By submitting User Content, you grant CringeAlert!! a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, perform, and distribute that content as necessary to operate, improve, and promote the service.

You are responsible for your User Content and for ensuring you have all rights necessary to post it.

3.2 Prohibited content

You agree not to post User Content that:

• Is illegal, abusive, harassing, hateful, threatening, defamatory, or invasive of another's privacy.
• Contains sexual content involving minors, or otherwise exploits or endangers children.
• Infringes or violates any copyright, trademark, or other intellectual property or proprietary rights.
• Contains spam, scams, or unsolicited promotions.
• Contains malware, viruses, or other harmful code.

We may remove or restrict access to User Content that we believe violates these Terms or applicable law, but we do not undertake any obligation to monitor all content.

4. Acceptable use

You agree that you will not:

• Use CringeAlert!! for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any account, system, or network related to CringeAlert!!.
• Interfere with or disrupt the operation of CringeAlert!!, including by overloading, flooding, or attacking the service.
• Use any automated means (such as bots, scrapers, or crawlers) to access, collect data from, or otherwise interact with CringeAlert!! without our prior written permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We may investigate suspected violations and take any action we deem appropriate, including account suspension or termination.

5. Intellectual property

CringeAlert!!, including its design, logo, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, you do not acquire any rights in CringeAlert!! or its content.

You may not copy, modify, distribute, sell, or lease any part of CringeAlert!! or reverse-engineer or attempt to extract the source code, except to the extent such restrictions are prohibited by law.

6. Third-party services, analytics, and ads

CringeAlert!! may display content, analytics, and advertisements from third parties or link to third-party websites or services. We do not control and are not responsible for third-party content or practices.

Your use of any third-party services is at your own risk and may be subject to separate terms and policies provided by those third parties.

7. Disclaimers

CringeAlert!! is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that CringeAlert!! will be uninterrupted, secure, or error-free, that defects will be corrected, or that the service is free of viruses or other harmful components.

8. Limitation of liability

To the fullest extent permitted by law:

• CringeAlert!! and its owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from or in connection with your use of CringeAlert!!.
• Our total liability for any claim arising out of or relating to these Terms or CringeAlert!! will not exceed the greater of (a) the amount you paid us (if any) in the 6 months before the event giving rise to the claim, or (b) 50 USD.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless CringeAlert!! and its owners, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of CringeAlert!!, your User Content, or your violation of these Terms or applicable law.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. In some cases, we may provide additional notice (for example, by posting a notice on the site or in your account).

If you continue to use CringeAlert!! after the updated Terms take effect, you agree to the new Terms. If you do not agree, you must stop using CringeAlert!! and close your account.

11. Termination

You may stop using CringeAlert!! and close your account at any time through your account settings (if available) or by contacting us.

We may suspend or terminate your access to CringeAlert!! at any time, with or without notice, if we reasonably believe that:

• You have violated these Terms or applicable law;
• Your use of the service creates risk or potential legal exposure for us or other users; or
• We decide to discontinue CringeAlert!!.

Upon termination, your right to use CringeAlert!! will immediately cease. Sections that, by their nature, should survive termination will remain in effect (including ownership provisions, disclaimers, limitations of liability, and indemnification).

12. Governing law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict of laws principles. You agree to submit to the personal jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to these Terms or your use of CringeAlert!!.
